EHCPs: what is proposed to change, and what is not

Reports suggested cutting back EHCPs. Here is where things stand.

There has been a lot of worry about EHCPs being scaled back or replaced. Some early reports pointed that way, and the response from families and charities was strong.

Where things stand now: EHCPs are staying. The changes being talked about are about making the process faster and less of a fight — clearer timescales, more consistent decisions between areas, and less need to go to tribunal to get a fair plan.

Your rights today: unchanged. The 20-week timescale for an assessment, your right to ask for one yourself, your right to appeal a refusal — all still apply. If you are mid-process, carry on as normal.
